The ground rules.

1. Who can use Card Motive

You must be at least 18 years old and able to form a binding contract. If you connect an eBay account, you must be authorized to manage that account and keep it in good standing under eBay's own rules. If you use Card Motive for a business, you confirm you can accept these Terms on its behalf.

2. Your account

Keep your sign-in details secure and accurate. You are responsible for activity under your account. Tell us promptly at cardmotivehelp@yahoo.com if you believe your account has been accessed without permission. One person or business per account; please don't share or resell access.

3. What Card Motive does — and what you stay responsible for

Card Motive uses artificial intelligence and public card databases to suggest card details, titles, descriptions, and other listing content from images you upload. Suggestions can be wrong. Card Motive is review-first: you decide what to approve, and nothing is published to eBay unless you take an action that publishes it.

You are solely responsible for every listing you create, approve, or publish, including its accuracy, condition description, grading claims, authenticity, price, shipping, and compliance with eBay policies and the law. Confidence scores, matches, and suggested prices are aids, not guarantees, and are not appraisals.

4. eBay and other third-party services

Card Motive is an independent tool. It is not owned by, endorsed by, or affiliated with eBay Inc. When you connect eBay, you authorize Card Motive to access your eBay account through eBay's official APIs to read your policies and locations and to create, update, publish, or withdraw listings when you ask it to. eBay's User Agreement continues to apply to your eBay activity, and eBay may change or limit its APIs at any time. You can disconnect eBay from the dashboard whenever you like.

The Service relies on other providers, including Stripe for payments, Supabase for sign-in, Cloudflare for hosting and storage, AI model providers for identification, and card reference sources such as TradingCardDB, Beckett, Scryfall, YGOPRODeck, and the Pokémon TCG API. Card, set, and brand names belong to their respective owners and are used only to describe cards.

5. Plans, billing, and automatic renewal

Card Motive offers a Free plan and paid monthly subscriptions (currently Seller and Dealer). Each plan includes a monthly number of card identifications; every identification, including re-identifying a card, counts once. Allowances reset on the first day of each calendar month (UTC), and unused identifications do not roll over.

Paid plans renew automatically every month at the then-current price until you cancel. By subscribing, you authorize us (through Stripe) to charge your payment method each billing period. You can cancel any time from Plan & Billing in the dashboard; cancellation takes effect at the end of the current billing period, and you keep paid access until then. Prices exclude any applicable taxes. We'll give at least 30 days' notice by email before changing the price of your plan, and you can cancel before the change applies. Refunds are covered by our Refund Policy.

If a payment fails, we may limit your account to the Free plan's allowance until payment is updated. We may change, add, or retire plans and features; if a change materially reduces a paid plan you already have, it will apply from your next billing period.

6. Your content

You keep ownership of the images, listing text, and other content you upload or create (“Your Content”). You give Card Motive a limited license to host, copy, process, and transmit Your Content only as needed to operate and improve the Service for you — for example, sending images to AI providers for identification, storing drafts, uploading images to eBay when you create a listing, and using your own approved listings as private style references for your future drafts. We do not sell Your Content. You confirm you have the rights to the content you upload.

7. Acceptable use

Don't use Card Motive to list counterfeit, stolen, or misrepresented items; violate eBay policies or any law; upload content you don't have rights to; interfere with or overload the Service; probe, scan, or bypass security or usage limits; reverse engineer the Service except where the law allows; or access it with bots or automated scripts other than through features we provide. We may suspend accounts that put sellers, buyers, eBay, or the Service at risk.

8. Beta and pilot features

Some features are labeled beta, pilot, or preview. They may change, be limited to certain accounts, or be removed, and they are provided as-is.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, CARD MOTIVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We don't promise that identifications, prices, or listings will be accurate, that the Service will be uninterrupted or error-free, or that any listing will sell.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, CARD MOTIVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, MISPRICED OR INCORRECT LISTINGS, eBAY ACCOUNT ACTIONS, OR LOST DATA. CARD MOTIVE'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID CARD MOTIVE IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

11. Indemnity

You agree to defend and hold Card Motive harmless from claims, losses, and costs (including reasonable attorneys' fees) arising from your listings, Your Content, your use of the Service, or your violation of these Terms, eBay's rules, or the law.

12. Ending your use

You can stop using Card Motive and ask us to delete your account at any time by emailing cardmotivehelp@yahoo.com. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the Service; where reasonable we'll give notice first. Sections that by their nature should survive (such as 6, 9, 10, 11, and 13) survive termination. Ending your Card Motive account does not remove listings already published on eBay.

13. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Please contact us first so we can try to resolve any concern informally. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Franklin County, Ohio, and you and Card Motive consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court.

14. Changes to these Terms

We may update these Terms as Card Motive grows. We'll post the new version here with a new date and, for material changes, notify account holders by email or in the dashboard before they take effect. Continuing to use the Service after changes take effect means you accept them.
